1. Controller
The controller for the data processing on this website is Accessify GmbH (in formation), Mainzer Str. 33, 55252 Mainz-Kastel, Germany. Contact: datenschutz@goaccessify.de.
2. Which data we process
- Server log files, for example IP address, time, page requested, browser and device type. This data is technically required for operation and security.
- Contact requests when you write to us. This includes your name, e-mail address and the content of your message.
- Newsletter data, if you sign up. This includes your e-mail address.
3. Purposes and legal bases
We process data on the basis of Art. 6 GDPR. This includes legitimate interests in secure operation pursuant to Art. 6 (1) lit. f GDPR, your consent for the newsletter pursuant to Art. 6 (1) lit. a GDPR, and the handling of your requests pursuant to Art. 6 (1) lit. b GDPR.
4. Hosting and storage location
Our servers are located in the EU. A data processing agreement pursuant to Art. 28 GDPR is in place with the hosting provider.
5. Storage period
We state concrete periods here instead of the usual formula that we keep data „as long as necessary". These periods are configured in our system and monitored daily.
- Dashboard account: until you delete it or ask us to. Deleting the account also removes the websites and settings held under it.
- Quick test without newsletter consent: 90 days. We only need the address to send you the result.
- Quick test with consent: 24 months without further contact.
- Newsletter sign-up that was never confirmed: 30 days. The confirmation link expires after seven days, after which no consent exists.
- After unsubscribing from the newsletter: 3 years. We keep the address as proof of the unsubscribe and as a suppression list so it is not added again by mistake.
- Feedback from the widget and the dashboard: 24 months.
- Orders and payments: 8 years. Invoices and orders are accounting records; § 147 (3) of the German Fiscal Code and § 14b of the German VAT Act require us to retain them. While that duty applies we cannot erase them even on request under Art. 17 (3) (b) GDPR, only restrict their processing.
- Log of who internally viewed, exported or erased personal data: 12 months.

General Terms and Conditions

1. Provider and scope
The provider is Accessify GmbH (in formation), represented by Marvin Malsy, Mainzer Str. 33, 55252 Mainz-Kastel, Germany, reachable at info@goaccessify.de. These terms apply to the free Accessify widget and to the paid audit report.
2. Two separate offers
The widget is free. There is no trial that turns into a subscription and no payment obligation that kicks in later.
The audit report is a separately orderable service at a price of 29.00 euros. This price is one-off and complete. No further invoices follow, there is no term and nothing renews. As a small business under § 19 of the German VAT Act we do not show VAT.
3. Formation of the contract
The contract for the audit report is formed when you press the „Zahlungspflichtig bestellen" (order with obligation to pay) button on the order page. The presentation of our services on the website is not yet an offer but an invitation for you to make one. We confirm receipt of your order by email without delay.
4. What the audit report contains
We check the website you specify for barriers, rank the findings by their impact on affected people and describe what to do about each one. It also states which findings the Accessify widget covers itself and which require a change to your website, and includes a template for the accessibility statement. You receive the report as a file by email.
We owe a careful review and a comprehensible report. We do not owe that your website will be assessed as accessible by an authority or a court after implementation. An automated check never finds every barrier; that applies to every tool on the market and to ours as well.
5. Payment
Payment is processed by Stripe. The amount is due upon ordering. The terms of Stripe Payments Europe, Ltd. additionally apply to the payment processing.
6. Right of withdrawal
Consumers have a right of withdrawal. The details, and the conditions under which it expires early, are set out in the withdrawal policy.
7. Your obligations
You only embed the widget on websites for which you are authorised, and you only have websites audited for which you are authorised. You do not use Accessify for unlawful purposes.
8. Availability and changes
We strive for stable operation but do not owe any particular availability. We may further develop the free widget, adapt it and change individual functions. An audit report already paid for is delivered in the scope described at the time of your order.
9. Liability
For intent and gross negligence, and for damage arising from injury to life, body or health, we are liable under the statutory provisions. In cases of simple negligence we are liable only for the breach of material contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.
Accessify adds extra controls to your website and does not replace a complete technical, professional or legal accessibility review.
10. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, please write to us directly at info@goaccessify.de; we would rather sort it out with you.
11. Final provisions
The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. Should individual provisions be invalid, the rest remains effective.
Withdrawal policy

This policy applies to the paid audit report. There is nothing to withdraw from for the free widget, because you neither pay nor sign up for anything.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us (Marvin Malsy, Mainzer Str. 33, 55252 Mainz-Kastel, Germany, info@goaccessify.de) of your decision to withdraw from this contract by an unequivocal statement, for example a letter or an email. You may use the model form below, but it is not mandatory.
The fastest route is our electronic withdrawal function: withdraw from the contract. You receive an acknowledgement of receipt there straight away, with date and time (section 356a of the German Civil Code).
To meet the withdrawal deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal. We will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
If you requested that we begin the audit during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you communicated your withdrawal, in comparison with the full coverage of the contract.
Early expiry of the right of withdrawal
In the case of a contract for a service, your right of withdrawal expires once we have fully performed the service and only began performance after you gave your express consent and at the same time confirmed your awareness that you lose your right of withdrawal upon our complete performance of the contract.
That is exactly why we obtain these two statements separately on the order page before we start work, and store the wording that was shown to you. If you do not give these statements, we wait until the fourteen days have passed before starting the audit.

If you wish to withdraw from the contract, you can fill in this form and return it to us. It is not mandatory; an informal email works just as well.
